Healthcare Litigators Stuart T. O’Neal and Harry McGrath secure dismissal of hospital client in Luzerne County, Pa.

Burns White Healthcare Litigators Stuart T. O’Neal and Harry P. McGrath obtained dismissal for a hospital client in a medical malpractice matter in Luzerne County, Pennsylvania, involving thirteen other facilities and physicians. The Honorable Judge David W. Lupas granted the dismissal based on an affidavit of non-involvement and subsequent motion submitted by the Burns White attorneys illustrating that the hospital had no part in the negligent care and treatment that was alleged. Following oral argument, the court issued an order dismissing the hospital client, with prejudice.

Burns White makes monetary donation to support breast cancer research

Breast cancer has touched many lives throughout the United States—and every now and again, it hits too close to home. To show a small token of support of Paralegal Shirlene A. Borsos’ battle against breast cancer, Burns White is donating $2,500 to her institution of choice — the Magee-Womens Research Institute, a home for University of Pittsburgh researchers who are engaged in research that spans reproductive biology and development, and diverse aspects of women’s health.

In an effort to increase awareness about the disease, Ms. Borsos was recently featured on KDKA news for an empowering moment captured on camera at a Tim McGraw concert.

Six Burns White attorneys named to Pennsylvania Super Lawyers/Rising Stars lists

PITTSBURGH, May 17, 2013 —Burns White Members David B. White in the Pittsburgh office, and William J. Mundy and Valerie H. Lieberman in the Philadelphia office were named to the 2013 Pennsylvania Super Lawyers list, a distinction received by no more than five percent of attorneys practicing in the state. In addition, Member Travis W. Smith and Associate Stephen A. Hall of Pittsburgh and Associate Angela A. Cronk of Philadelphia were selected for the Rising Stars list.

A Super Lawyer since 2004, Mr. White brings to his clients more than 30 years of demonstrated legal experience spanning several industries and areas of litigation including financial services, commercial, products liability, professional malpractice and employment, coupled with practical business acumen and strong leadership skills as a team builder and project manager. Mr. White earned both B.S. and J.D. degrees from Duquesne University.

Mr. Mundy has been rated a Super Lawyer since 2005. As Co-Chair of the firm’s Healthcare and Long-Term Care Practice Group, his practice focuses on the representation of long-term healthcare providers in the defense of medical malpractice and professional liability claims. Mr. Mundy obtained a B.A. from the Pennsylvania State University and a J.D. from Villanova University.

A second year Super Lawyer, Ms. Lieberman is a member of the firm’s Workers’ Compensation Group and serves on the Workers’ Compensation Section Executive Council of the Pennsylvania Bar Association. Pittsburgh

Litigator Laura E. Benson focuses in professional liability and commercial litigation, defending lawyers, accountants and medical professionals against liability claims and disputes. Prior to joining Burns White, Ms. Benson was employed as an associate at Weinheimer, Schadel & Haber, P.C., where she practiced professional malpractice defense and civil litigation. Ms. Benson received a J.D. from the University of Pittsburgh and a B.A. from Pennsylvania State University.

Craig J. Emmert is part of the Energy Group at Burns White, handling oil and gas lease litigation, as well as title curative and certified title opinions. Experienced in many aspects of the industry, Mr. Emmert wrote certified title opinions for oil and gas exploration and production companies, and handled oil and gas lease disputes as an associate at Lawrence D. Brudy & Associates. He also worked as a crew chief and landman at an oil and gas land services company. Mr. Emmert received a J.D. from the University of Pittsburgh and a B.A. from Washington & Jefferson College.

Philadelphia

Kevin J. Riefenstahl brings a wealth of multi-disciplinary experience to his workers’ compensation practice at Burns White, including New Jersey and Pennsylvania workers’ compensation, Social Security disability and financial analysis. Prior to joining the firm, Mr. Riefenstahl worked in New Jersey and in Pennsylvania representing employers and self-insured employers as well as claimants before the Social Security Administration; analyzed matters to create legal strategies for claims, developed client tracking and reporting systems; and served in the United States Navy as a Data Processing Technician. Healthcare litigator Darla A. Mushet rejoins Burns White from Casey & Chapman, PLLC. With an extensive background in the healthcare industry, Ms. Mushet focuses in medical malpractice defense and healthcare risk management. She was employed as a staff nurse with the University of Pittsburgh Medical Center, the Wheeling Dialysis Center and the Wheeling Hospital and as a home dialysis coordinator at the Wheeling Dialysis Center. Prior to obtaining a law degree, she practiced as a legal nurse consultant on medical malpractice matters. ACBA elects Sheila Burke to serve on its Women in the Law Division Council

Member Sheila M. Burke was elected to serve a three-year term on Allegheny County Bar Association’s (ACBA) Women in the Law Division Council effective July 1, 2013. As a council member, Ms. Burke will be tasked with providing direction to the group to support its mission of promoting the success and advancement of women attorneys in Allegheny County.

Members T.H. Lyda and Edwin Palmer publish article about trade secret challenges under PA Act 13

Members T.H. Lyda and Edwin B. Palmer authored an article in the April 2013 edition of The PIOGA Press, a monthly newsletter of the Pennsylvania Independent Oil & Gas Association. Titled “Can you keep a secret? Trade secret challenges under Act 13,” the article looks at Act 13’s ability to strike a balance between drilling companies’ interests in keeping their proprietary chemical additives to frac fluid confidential and the public’s interest in learning about potential health concerns from exposures to these unknown chemicals. Burns White Founding Member receives Duquesne University’s Distinguished Alumni Award

PITTSBURGH, April 16, 2013David B. White, Founding Member of Burns White LLC, was one of two individuals named as this year’s Distinguished Alumni by Duquesne University School of Law. Mr. White is slated to receive this award on April 19 at the 61st Annual Law Alumni Reunion Dinner, where Former White House Counsel John Dean will be making a special guest appearance.

Mr. White, who was nominated by his peers, was selected by the university for his distinguished achievements in the legal profession. With more than 30 years of experience, Mr. White’s demonstrated legal experience combined with practical business acumen and strong leadership skills have been recognized by his peers and clients throughout Allegheny County and beyond. One of the greatest testimonials to his leadership is the growth of Burns White. Since its inception in 1987, the firm has flourished from a staff of 12 to more than 240 individuals across nine office locations in five states, branching out from its strong roots in civil litigation to become a full-service entity spanning 18 practice areas.

Mr. White received a B.S. in Biology from Duquesne University in 1977 and obtained a J.D. from Duquesne’s four-year evening division in 1982, while working as a law clerk at a local law firm.
