Dollar Energy Fund appoints Ralph Monico to its Board of Directors

The Dollar Energy Fund appointed professional liability litigator Ralph M. Monico by board vote to serve on its Board of Directors, as well as its Planning Committee. In this role, Mr. Monico will help set the strategic direction of the organization whose mission is to improve the quality of life for households experiencing hardships through utility assistance and other services.

The Ohio Supreme Court held yesterday that abandoned mineral interests were not automatically extinguished under the 1989 version of the Ohio Dormant Mineral Act (ODMA). The Court ruled in Corban v. Chesapeake Exploration, L.L.C., that any surface owner seeking to claim ownership of a dormant mineral interest after June 30, 2006, must comply with the provisions of the 2006 version of ODMA, which includes notice and recording requirements. Member and Co-Chair of the Insurance Coverage and Extracontractual Litigation Group Christopher Jacobs and Associate Matthew Meyers penned an article for The Legal Intelligencer’s insurance law supplement. Published in the Aug. 30, 2016 edition, the article looks at whether the Pennsylvania Superior Court’s recent holding in Selective Way Insurance v. Hospitality Group Services, 119 A.3d 1035 (Pa. Pa. federal court grants partial summary judgment to an energy client in a contractual indemnification dispute

The U.S. District Court for the Middle District of Pennsylvania granted a partial summary judgment to an energy client in a contractual indemnification dispute.

Represented by Chair and Member of the Energy Group Matthew G. Brouse and Associate Jennifer L. Beresky, the Burns White client was a co-defendant in a personal injury lawsuit where the plaintiff sustained injuries while performing work for one company on a well site that was owned and operated by the Burns White client. A cross-claim was filed by the co-defendant for common law contribution and indemnification, as well as contractual indemnification. In response, Burns White filed a motion to dismiss the contractual indemnification count, asserting that our client was not required to indemnify for personal injury claims made by subcontractors as stated in the master service agreement and filed a crossclaim for breach of contract. In the end, the court granted our client’s motion for partial summary judgment requiring the co-defendant to cover all legal costs and cost of settlement.
